Terms & Conditions

Draft prepared: 26 September 2026 · Not yet effective

1. The agreement and service provider

These terms govern business use of M2POS. “You” means the business subscribing and its authorised users; “we” means William Scott, trading as Gemica Tech. An authorised representative must accept the terms when creating an account or ordering a subscription. This review draft does not replace your existing agreement. The operator’s legal name, business address, effective date and governing law must be completed before publication.

2. Service scope and plans

M2POS provides cloud software for restaurants, hospitality, retail and online selling, with business management tools where available. Features, user limits, AI allowances and support depend on the selected plan and the offer confirmed at purchase. Hardware, internet access, banking services and third-party subscriptions are excluded unless expressly included. A feature description is not a promise of certification, accreditation or compliance in every country.

3. Accounts and authorised access

Provide accurate account and billing details, keep contact information current, and manage staff access and credentials carefully. Grant only the permissions each person needs, remove access when staff leave, and report suspected compromise promptly. You are responsible for instructions given by your authorised users; this does not excuse a security failure caused by us. Do not share access with unrelated businesses or resell the service without written permission.

4. Trials, subscriptions and billing

Trial duration and available features are shown when you sign up. When a trial or paid period ends, access may revert to the Free plan and its limits unless a paid plan is activated. Paid plans are monthly unless the accepted offer states otherwise. The confirmed order or invoice must state the amount, currency, applicable taxes, billing period and activation arrangements. An IP-based website price is an indication; the confirmed order controls your payment. Automatic recurring charges require your separate authorisation. You bear bank or currency-conversion charges disclosed by your provider. Price increases for an existing subscription require at least 30 days’ notice and apply to a future renewal, not a period already paid for.

5. Cancellation and refunds

Request cancellation or a plan change through available account controls or billing@mymultipos.com before the next renewal. Cancellation normally takes effect at the end of the paid period; deleting an account is a separate request. Fees for a period already started are normally not refunded solely because you stop using the service. This does not limit mandatory legal rights, correction of duplicate or mistaken charges, or remedies for a service we fail to provide. Send payment evidence for a billing dispute; we will investigate and explain the outcome. If we discontinue a prepaid service for our own convenience, we will refund the unused portion.

6. Merchant payments and QR support

Payment tools may display or generate merchant QR codes, including supported PromptPay, KBZPay/KPay and MMQR arrangements. Availability depends on your country, merchant account and configuration. M2POS is not a bank, does not hold customer funds, and QR display does not itself confirm payment or guarantee settlement. Check the recipient, amount and actual receipt in your bank or wallet before marking a sale paid. You manage merchant eligibility, refunds, charge disputes and provider terms. Naming a payment network does not imply endorsement or an official partnership.

7. Your data and privacy

You retain rights in your business data and give us permission to host, process and transmit it only as needed to provide, secure and support the service and meet legal obligations. We do not sell your business data. You must have a lawful basis for collecting customer and staff information and provide required notices. Our Privacy Policy explains processing, providers and deletion. Where legally required, a separate data-processing agreement must be completed; these terms are not a substitute for it. Do not upload data you have no right to process.

8. Exports, retention and deletion

Keep copies of records required for your business, tax and legal obligations. Use available export tools and contact support before closing an account if you need help retrieving data. Cancellation of a paid plan does not itself request deletion. The current retention policy keeps suspended-account data for 30 days; request export promptly within that period. Verified deletion requests are handled under the Privacy Policy, subject to lawful retention and backup expiry. Deleted or expired data may be unrecoverable. We do not promise a particular backup recovery time or loss-free restoration without a separate written agreement.

9. AI and connected platforms

AI features may use external providers such as Google Gemini and are subject to plan quotas. Outputs, extracted invoice details, analysis and marketing drafts may be inaccurate; review them before saving records, publishing or making decisions. They are not professional legal, tax or financial advice. Use connected social accounts only with permission and ensure you have rights to submitted content. Review the content, destination and publishing instructions you authorise. External platforms have their own terms, availability and restrictions; disconnecting an account does not remove posts already published. Data handling remains subject to the Privacy Policy.

10. Permitted use and ownership

Your subscription grants a limited, non-exclusive right to use the service for your business during the applicable period. M2POS software, branding and documentation remain ours or our licensors’. Your data and content remain yours or their respective owners’. Do not infringe others’ rights, upload malware, access another business’s data, bypass limits, or disrupt the service. Security testing requires prior written permission. You must check local tax, receipt, payroll and business requirements and configure your records accordingly; software settings alone do not establish legal compliance.

11. Availability, support and suspension

Maintenance, internet failures and external-provider outages can interrupt access. We will give reasonable notice of planned maintenance where practical; no specific uptime or response-time commitment applies unless agreed in writing. We may proportionately restrict access for overdue fees, material breaches, security threats or legal requirements. Where practical, we will explain the reason and allow a reasonable opportunity to resolve it; urgent risks may require immediate action. Contact support to discuss restoring access and retrieving data where legally and safely possible. Ending access does not remove accrued payment obligations or mandatory legal rights.

12. Warranties and liability

We will provide the service with reasonable care and skill, but do not promise uninterrupted access or that every error can be corrected. To the extent permitted by law, neither party is liable for indirect or consequential loss. Nothing excludes liability that cannot lawfully be excluded, including applicable liability for fraud, deliberate misconduct or gross negligence. A financial liability cap has not been selected for this draft and must be agreed before publication; this clause does not set a zero-liability cap for Free users. Mandatory remedies and rights remain unaffected.

13. Changes, notices and disputes

Material changes to these terms will normally be notified at least 30 days before they take effect, using your registered email or an account notice. Urgent legal or security changes may take effect sooner with an explanation. Changes do not retrospectively remove accrued rights. You may decline a future renewal before the change takes effect. Raise disputes with support@mymultipos.com so both parties can seek a good-faith resolution; this does not prevent urgent relief or statutory complaints. Governing law and the competent courts remain pending identification of the current operator. No UAE, Thai, Myanmar or Cyprus jurisdiction is selected by this draft.

14. Language, other agreements and contact

English, Burmese and Thai versions are intended to carry the same meaning. If they differ, the English version will guide interpretation only to the extent local law permits. A separately signed order or data-processing agreement prevails for its specific subject where it expressly changes these terms. An unenforceable clause does not invalidate the remaining clauses. For service or privacy questions contact support@mymultipos.com; for subscription payments and cancellation contact billing@mymultipos.com. The final version will identify the operator and effective date clearly.
